Federal Tax Policy — IRA, CHIPS, and Section 174

Glossary

Advanced Manufacturing Investment Credit (Section 48D)
The CHIPS Act's federal investment credit for property used to manufacture semiconductors and the equipment to make them. A supply-side instrument one link upstream of the data center, it lowers the hurdle rate for building domestic fabrication capacity.
Clean Electricity Investment Credit (Section 48E)
A technology-neutral federal credit that rewards capital invested in a facility generating electricity with net-zero greenhouse gas emissions, claimed as a percentage of eligible cost when the facility is placed in service.
Clean Electricity Production Credit (Section 45Y)
A technology-neutral federal credit that rewards the electricity a qualifying net-zero-emissions facility actually generates, claimed as a per-kilowatt-hour amount over the first ten years of operation.
Credit transferability (Section 6418)
A provision allowing a party that earns an eligible credit to sell it for cash to an unrelated taxpayer. It widens the pool of capital that can monetize credits and raises the share of a credit's value that actually finances a project.
Elective payment / direct pay (Section 6417)
A mechanism letting entities with little or no tax liability — chiefly governments, public power authorities, and tax-exempt organizations — receive an eligible credit's value as a cash payment from the Treasury rather than as an offset against tax.
Hurdle rate
The minimum return a capital project must be expected to earn to be worth building. Federal tax credits act on it by lowering a project's after-tax cost of capital, so that generation or fabrication which would otherwise be uneconomic becomes buildable.
Prevailing wage and apprenticeship requirements
Labor conditions that unlock the higher, bonus tier of the clean-electricity credits. Meeting them raises the credit several times above the base amount; the headline rate quoted in the press is typically this bonus tier, not the base.
Research and experimental expenditure capitalization (Section 174)
The post-2021 rule requiring specified research or experimental costs — including software development — to be capitalized and amortized over several years rather than expensed immediately. It re-times deductions, raising near-term taxable income and reducing cash flow, with no effect on where anything is built.
